Welcome to Lift Leader. These Terms and Conditions ("Terms") govern your use of our mobile application and website (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By downloading, installing, or using the Lift Leader app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

2. User Eligibility

To use our services, you must be at least 13 years old or the minimum legal age in your jurisdiction. By using Lift Leader, you confirm that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account Registration and Security

You may need to create an account to access certain features. You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

4. AI Training Assistant Services

4.1 Service Description

Our AI Training Assistant provides personalized workout recommendations, training analysis, and fitness guidance based on your workout data and interactions. The AI service operates on a token-based system.

4.2 Token System

• Free Tokens: New users receive free tokens to try our AI features
• Premium Tokens: Additional tokens can be purchased through in-app purchases
• Token Usage: Each AI interaction consumes tokens based on the complexity and length of the conversation
• Token Expiration: Tokens may have expiration dates as specified in your purchase

4.3 AI Service Limitations

You acknowledge and agree that:

• AI recommendations are for informational purposes only and not professional medical or fitness advice
• AI responses may contain errors or inaccuracies
• You should consult healthcare professionals before starting any new fitness program
• The AI cannot replace professional trainers, coaches, or medical professionals
• Service availability may be subject to technical limitations or maintenance

5. Subscription and Payment Terms

5.1 Premium Token Purchases

• Monthly Subscription: $4.99/month for premium token access
• Annual Subscription: $49.99/year for premium token access
• Payments are processed through your device's app store (Apple App Store or Google Play)
• Subscriptions automatically renew unless canceled before the renewal date

5.2 Refunds and Cancellations

• Refund policies are governed by your app store's terms and conditions
• You can cancel subscriptions through your device's subscription settings
• Cancellation takes effect at the end of the current billing period
• Unused tokens may not be refundable upon cancellation

6. User-Generated Content

Users may submit content such as workout logs, comments, questions to the AI assistant, and gym ratings. By posting content, you:

• Grant Lift Leader a non-exclusive, royalty-free license to use, display, and distribute your content within the App
• Confirm you own the rights to the content or have permission to share it
• Are responsible for ensuring your content does not violate any laws or third-party rights
• Understand that AI conversations may be used to improve our services (in anonymized form)

7. Prohibited Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Engage in fraudulent or deceptive activities
• Post harmful, abusive, harassing, or inappropriate content
• Attempt to manipulate or abuse the AI system or token system
• Interfere with the operation of the App or other users' experience
• Reverse engineer, decompile, or attempt to extract the source code
• Share your account credentials or transfer your account to others
• Use the AI service to generate content that violates our community guidelines

8. Health and Safety Disclaimers

IMPORTANT: Lift Leader and its AI Training Assistant are not medical devices and do not provide medical advice. You acknowledge that:

• All fitness activities carry inherent risks of injury
• You should consult a healthcare provider before beginning any exercise program
• AI recommendations are general guidance and may not be suitable for your specific health conditions
• You participate in fitness activities at your own risk
• Lift Leader is not responsible for any injuries or health issues that may result from using our Service

9. Intellectual Property Rights

The Lift Leader app, including its AI technology, algorithms, content, and design, is owned by Lift Leader and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our proprietary technology
• Use our trademarks or branding without permission
• Create derivative works based on our Service
• Attempt to replicate our AI training assistant technology

10. Service Availability and Modifications

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Update our AI models and algorithms to improve performance
• Change pricing for premium features with reasonable notice
• Implement usage limits or restrictions as needed

11. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to our data practices as described in the Privacy Policy.

12. Disclaimer of Warranties

Lift Leader is provided on an &quotas-is&quot and &quotas-available&quot basis. We make no warranties regarding:

• The accuracy, reliability, or availability of the App and its services
• The accuracy of AI-generated recommendations or advice
• Uninterrupted or error-free operation
• The suitability of our Service for your specific needs

Use of the App is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, Lift Leader shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Personal injury or property damage resulting from your use of the Service
• Any damages resulting from AI-generated advice or recommendations

In no event shall our total liability exceed the amount paid by you for using the App in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Lift Leader from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit or share through the Service

15. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, including if you violate these Terms. Upon termination:

• Your right to use the Service ceases immediately
• You may lose access to your account and data
• Unused tokens may be forfeited
• Provisions of these Terms that should survive termination will remain in effect

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the app or on our website. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
